I'm not sure on the specifics, but there has been this notion out there for sometime that if it was federal park land, it's ok to have a cross. This is the same thing that was attempted last summer when 3/4 of voters voted to transfer the land to the feds for park land....that ballot measure was lat...

Another update! Our mayor and a congressman are trying to get President Bush to exercise eminent domain and take the land over. Toto: The difference was, the city tried to deed the land to the feds (something about crosses being ok on federal memorials), as opposed to selling it to a private citizen/organization. New info to report: Although various measures are on appeal and cross-supporters are still looking for loopholes and other opporutnities to maneuver, the judge has now said that the city of san diego must have the cross down in 90 days or else pay $5,000 per day after that that it is up.
